This includes ensuring that ISPs have a secure network, the user data is protected, and the transmission of illegal or harmful content is prevented by ISPs. 

  • Monitoring and Reporting Suspicious Activity: ISPs must regularly monitor their networks for suspicious or malicious activity. If they find any such activity, then they must support the same to the relevant authorities like Indian Computer Emergency Response Team (CERT-In) or other law enforcement agencies. To prevent or reduce the extent of cyber attacks and data breaches, the ISPs must adopt security measures.

  • DoT and TRAI regulations for ISP: Internet service providers must, at all times, ensure their compliance with rules and regulations issued by the Department of Telecommunications, Telecom Regulatory Authority of India (TRAI) and other relevant regulatory bodies. Failure to ensure compliance can attract penalties, and in some cases, lead to cancellation of the ISP license.

  • Assisting Law Enforcement Agencies: Whenever a cybercrime investigation takes place, the ISP must cooperate with the law enforcement agencies. If needed, they must provide information, logs and technical support to help the law enforcement authorities track and understand what the cybercriminals are up to.

  • Retention/Disclosure of Data: To ensure compliance with legal requirements, the ISPs may be required to retain user data and disclose crucial information to law enforcement/government agencies.   • Forbidding Access to Illegal Content: Measures must be taken by internet service providers to block access to illegal or prohibited content, such as websites containing content which violates copyright laws or human rights, websites promoting terrorist organization, etc. To ensure such content is blocked, ISPs can take measures which include mechanisms for filtering content or comply with government orders to block accessibility to such content.

  • Educating Users and Creating Cybersecurity Awareness: Internet service providers must promote user education and awareness regarding best practices for cyber security by providing information and resources to their users so that they can protect themselves when they face cyber threats like malware, identity theft, scams, etc. Although not mandatory, this will allow the ISPs to run smooth business operations and help to prevent cybercrime to a great extent.

  • Net neutrality regulations India: The net neutrality regulations came into effect in July, 2018. These regulations were rolled out to ensure equal treatment of internet traffic across India, regardless of the content, its sender or recipient. There cannot be different charges by service providers for data based on content. If the ISPs violate these rules, they can face a penalty of up to Rs. 50 lakh or get their license canceled.
