Trademark Law defines 45 classes under which the service & goods of a business fall. Therefore, before applying for a trademark, a person must search under which class the goods/service of the business falls.
The International (Nice) Classification of Goods and Services has classified different goods and services into 45 Trademark Classes (1 to 34 cover goods, and 35 to 45 services). The Indian Trademark Registry uses this classification to classify trademarks.
The idea behind this system is to specify which goods or services are covered under a particular class. So, for example, if a company is selling laptops under the brand name of ‘Rell,’ then the company can file a Trademark application to register the mark “Rell” under TM class 9 only, which is a relevant class to register products related to electronic goods.
It means that if another company uses this mark for some other products, such as a pressure cooker, then that company is allowed to use the mark “Rell” because the pressure cooker falls under a different TM Class 21.
But there is an exception if the mark is well-known, such as Pizza Hut. Although this mark comes under only one class, Class 43, yet another company, if wish to use the mark Pizza Hut, then that company has to take prior permission of Pizza Hut mark’s owner.
Further, the classification is divided into two parts broadly as goods and services, which are defined below:
There are 34 classes of goods and 11 classes of services. Goods come under classes commencing from 1 to 34, and Services come under classes commencing from 35 to 45. Below are the links to all 45 classes with detailed descriptions of all the goods and services covered in these classes. The applicants can avail of this facility to choose the right kind of class for their goods and services.
Sometimes, your trademark falls under more than one type of good. Therefore, you can apply to more than one class.
Multiple-class application is an application for trademark registration in which the applicant seeks registration for more than one class. A multi-class trademark application streamlines the registration process in a cost-effective manner. Moreover, It is easier to track a single application than multiple applications.
But you have to be very cautious before filing a multi-class application. It is suggested that if you are cent percent sure that the proposed mark is unique and distinct, your application can be rejected altogether.
