CTE full form is Consent to Establish. It is a certificate which serves as a clearance required for setting up an industry, plant or process. A CTE must be obtained from the appropriate state pollution control board for every industry, operation, or process that releases trade or sewage effluent into the environment or has the potential to release air pollution into the atmosphere.
CTE Certificate confirms that a project’s plans are in compliance with the pollution control standards. It is necessary to obtain the CTE registration Certificate under the Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981. To obtain this approval, you must apply with the State Pollution Control Board or Pollution Control Committee. The process for obtaining consent to establish certificate takes place in the following manner:
Depending on your state, the application for a CTE certificate must either be submitted online or offline to the regional office. Along with the CTE certificate application, you must attach all the required documents. If the application process is online, you can submit it on the concerned board’s OCMMS portal and pay the prescribed fee.
Once the application for CTE registration is received, all the details provided in the application will be examined and all the submitted documents will be checked.
Once the scrutiny or initial inspection report is completed, the application for CTE certificate will be forwarded to the approving authority. The entire processing time for a final decision can take approx. 120 days from the date on which the complete application is received. In most cases, the establishment is issued a provisional CTE.
If the project is not finished before the expiration of the CTE certificate, the applicant must apply for renewal of this certificate. For the renewal, the project or unit must follow the procedure specified by the SPCB of their respective state.
Projects seeking auto-renewal of the certificate must apply through the respective Board’s OCMMS portal. The application for renewal must be made between 30-90 days before the previous consent to the establishment's expiration. Along with the application, the prescribed fees and required documents must be submitted.
