Legal Metrology Act Registration
The Legal Metrology Act of 2009 is responsible for establishing standards of weights and measures. The Bill regulates trade and commerce in terms of weights and measurements. It also includes other goods sold and distributed by measures and/or numbers. The L.M. Act is applicable throughout the country. The Registration under the Legal Metrology Act is sometimes called the LMR Act (Legal Metrology Packaging Registration) or LMPC Rules (Legal Metrology Packaged Commodity Rules.
Businesses under Legal Metrology
A commodity dealer, where weight, measures and number measure products, must register himself under the Legal Metrology Act. The businesses specified under the Metrology Law include buying, selling, and distributing the products by such weight or measure. These transactions are made for any of the following reasons:
A commission agent, an importer, or a manufacturer generally operates a Metrology Firm providing the following services with respect to the measurement units:
Section 19: As per the Legal Metrology Packaging Registration rules, no individual can import any weight or measure if he is not registered with the Metrology Authority. He or she must also hold a valid LMPC Certification.
Section 38: As per the Legal Metrology Packaging Registration rules, the authority will impose a penalty on the entity if any individual or business indulges in importing any weight or measure. Such entities are registered under the Legal Metrology Act. The penalty can extend up to Rs 25000 for the second as well as a subsequent offence. The offence can also invite imprisonment for a term extending to six months
The Ministry Of Consumer Affairs from the Department of Consumer Affairs had issued a notification in New Delhi on September 30, 2022, regarding Food And Public Distribution. The G.S.R. number of the Notification is 747(E).
The Notification states that the powers conferred by sub-section (1) with clauses (j) and clause (q) of sub-section (2) of section 52 of the Legal Metrology Act of 2009, as per the inherent directions from the Central Government, had made the following rules to amend further the LMPC Rules (Legal Metrology Packaged Commodities) of 2011.
(1) The amended rules are called the Legal Metrology (Packaging Commodities) Amendment Rules of the year 2022.
(2) The amendment will come into force on the date of their publication in the Official Gazette.
(3) Also, in the Packaged Commodities Amendment Rules, 2022, in Rule 1, the phrase with figures, letters, and words “1st day of October 2022” is by the phrase with the figures, letters, and words “1st Day of December 2022”. This means there has been a change in the date of event occurrence previously.
The notification was issued from the office of Joint Secretary Anupam Mishra.
The reader must also note that the Legal Metrology (Packaged Commodities) Amendment Rules of 2022 were first published in the Extraordinary part of the Gazette of India. They were detailed in Part II, Section 3, Sub-section (i) with the number G.S.R. 226(E). The date of such amendment was March 28, 2022.
